Land Use Plans
Ports North has prepared Land Use Plans (LUPs) for all strategic port lands under its control.
Section 285 of the Transport Infrastructure Act 1994 requires each Port Authority to prepare Land Use Plans (LUPs) for approval of the Minister of Transport, with such plan to -
- specify details of
- the Port Authority’s strategic port land;
- the land the Port Authority proposes to become strategic port land; and
- the current and proposed uses of the land;
- coordinate and integrate the core matters relevant to the LUPs;
- identify desired environmental outcomes of the land; and
- include measures that will help achieve the desired environmental outcomes.
Strategic port land is land that is included in the Port Authority’s current LUPs approved under Section 286(5) of the Transport Infrastructure Act 1994. Development control of strategic port land within the responsibility of Far North Queensland Ports Corporation Limited (Ports North).
Amendments to the Integrated Planning Act 1997 (IPA) and the Transport Infrastructure Act 1994 (TIA) in December 2000 made Port Authorities the Assessment Manager under IPA for developments undertaken wholly on strategic port land. The Sustainable Planning Act 2009 (SPA) and associated Sustainable Planning Regulation 2009 (SP Reg) came into effect on 18 December 2009 replacing the IPA.
Integration of assessable development on strategic port land into the Integrated Development Assessment System (IDAS) is achieved by SPA.
Where development is proposed on land or water outside of the Port Authority's control, another State agency or entity will be the Assessment Manager. The boundaries of strategic port land within Ports North's LUPs have been defined so that development within any particular precinct shall be wholly contained on strategic port land, to avoid (where possible) any confusion as to who is responsible for the assessment of any development applications.
The LUPs have been prepared as a planning documents consistent with the provisions of the SPA. In this way, development controls on port strategic port land will be similar in many ways to development controls on adjacent land under the control of the relevant Council.
